Your key to safe driving

JURISDICTION AND LAW

These Terms and Conditions are governed by and shall be construed in accordance with the laws of England and Wales. Disputes arising in relation to the same shall, unless otherwise expressly agreed, be subject to the exclusive jurisdiction of the courts of England and Wales.

These terms and conditions may be changed at any time any you will be deemed to have accepted any such change once published on the website unless you inform Dedham Vale Driving School to the contrary.

TUITION

Your contract for driver tuition is solely between you and your instructor (your ‘Instructor’) who is a self-employed franchisee of Dedham Vale Driving School.

These Terms and Conditions apply to that contract.

Dedham Vale Driving School is not a party to that contract and will not be liable for any breach on the part of your instructor.

CHARGES AND PAYMENT

Dedham Vale Driving School reserves the right to change lesson prices at any time.

Special offers may from time to time be advertised however, these are not available to any current pupil. Special offers may be withdrawn at any time and without notice.

Payments for weekly lessons must be paid for in advance or at the time of the driving lesson.  Failure to pay may result in the lesson being cancelled by the instructor.

You can make payments by cash or BACS to your instructor at the start of your lesson.

Block payments are only available to purchase for driving lessons taken from Monday to Friday and not weekend lessons unless the instructor agrees to this arrangement.

Sums paid in advance by you or on your behalf for driving lessons to be provided in the future can be paid directly to the instructor or Dedham Vale Driving School who will arrange payment to your instructor. Dedham Vale Driving School acts solely as an agent for your instructor.

Dedham Vale Driving School accepts no liability for any payments made directly to your instructor.

Gift Vouchers are non-refundable, not redeemable for cash and must be used within one year of the issue date.

Gift vouchers are for the individual named on the voucher, are not transferable and cannot be resold.

INTENSIVE COURSE PAYMENTS

In addition to the above Charges and Payment section a deposit of 50% must be paid for any intensive course four weeks before the start date of the course. Without this deposit a course cannot be guaranteed to proceed.

YOUR LESSONS

You and your instructor are responsible for agreeing all matters relating to the timing, location and duration of individual lessons.

You must present your valid UK provisional driving licence prior to the start of your initial lesson. Should you fail to do so, your instructor reserves the right to refuse to provide you with tuition or to cancel any lessons you have booked with them, and you may be charged the full value of that lesson.

You must meet the minimum eye test requirements, which means you must be able to read a standard UK approved number plate at a minimum distance of 20.5 metres (67 feet). If you need to wear glasses or contact lenses in order to meet this requirement then you must wear them whenever you drive.

You must notify your instructor of any change of your ability or entitlement to have driving tuition, for example your provisional licence has been revoked or for medical reasons such as epilepsy.

You must notify your instructor of any matters existing at any time that may affect your ability or entitlement to have driving tuition, for example, but not limited to, any lack, or loss, of a valid provisional driving licence.

In the event of any of the following, your lesson will be terminated immediately:-

You engage in any conduct that your instructor in his or her sole discretion considers to be reckless or dangerous.

Your instructor has reason to believe that you are under the influence of drugs or alcohol.

No refund will be granted in these circumstances.

In the event that your lesson is cancelled by your instructor, other than in the circumstances above your lesson will be rearranged for a mutually convenient time or, if that is not possible, you will be offered a refund for that lesson.

While every endeavour is made to commence the lesson at the scheduled time and with the scheduled instructor, no responsibility can be taken for circumstances beyond our control which may delay the start time or result in a change of instructor. If there are circumstances beyond our control which have delayed the start time of your lesson, we will offer you the full lesson time or, if that is not possible, we will offer you a lesson at another time.

REFUNDS

At least 48 hours notice must be given to your instructor if you wish to cancel or re-arrange booked lesson. Failure to do so may result in your instructor charging you the full amount for that lesson.

Prepaid lessons must be taken by you within one year of the date of your original payment. You will not be entitled to a refund after the expiry of this period. At any point during this one year period, if you don’t wish to take any of the prepaid lessons then you are entitled to a refund. You will charged for every lesson that has been taken at our standard rate and you will be refunded the difference.

Prepaid lessons may not be sold or transferred to any other person.

INTENSIVE COURSE REFUNDS

In addition to the Refund Terms section above there will be no refund to a deposit if the course is cancelled within 14 days of the start date by the student. If the instructor cancels the course for whatever reason a full refund will be offered or the course rearranged.

No refund will be issued where an intensive course is cancelled by the pupil before the course has been completed.

LIABILITY

Neither your instructor, nor Dedham Vale Driving School will be liable to you for any loss or damage caused where, and to the extent that:

  • there is no breach of a legal duty owed to you by the relevant person or body
  • such loss or damage is not a reasonably foreseeable result of such a breach
  • any such loss or damage, or increase in the same, results from any breach or omission by you.
  • any such loss or damage results from circumstances or matters outside of the reasonable control of the relevant person or body.

Under no circumstance shall Dedham Vale Driving School or your Instructor be liable for any loss relating to any business operated by you including but not limited to loss of profit.

Nothing in these Terms and Conditions will affect any statutory rights you may have as a consumer.
